Data Protection Policy of Tapetenfabrik Gebr. Rasch GmbH & Co. KG
(hereinafter, «Rasch»)

The following data protection provisions contain information about how, why and to what extent we collect and use personal data. We only collect and use such data in accordance with the provisions of German data protection law.

§ 1 Collection, processing and use of data

1. Rasch collects, processes and uses the personal data of the user or customer (e.g. title, name, address, date of birth, e-mail address, telephone number, fax number, bank details, credit card number) on the basis of and in compliance with the data protection laws, in particular the German Telemedia Act (TMG) and the German Data Protection Act (BDSG).

2. Where personal data is required to establish, form the content of, or amend the contractual relationship («inventory data»), Rasch will only use this data for the purpose of performing the contract, e.g. delivering goods to the specified address. Any other use of inventory data for the purpose of advertising, market research or tailoring Rasch‘s services to requirements requires the explicit consent of the user or customer. This declaration of consent is entirely voluntary and may be accessed by the user or customer via the Rasch website and revoked at any time by the user or customer (see § 4).

3. Likewise, personal information that is needed to facilitate the use of Rasch’s services and for billing purposes («usage data») will only be used by Rasch for the purpose of performing the contract. Such usage data includes in particular the features identifying a user as such, details about the start/end and extent of the use in each instance, as well as details about the teleservices used by the user or customer. For the purpose of advertising, market research and tailoring our teleservices to requirements, Rasch will also use such usage data to create user profiles under pseudonyms. The user or customer is able and entitled to object to their usage data being used in this way (see § 4). The user profiles will not under any circumstances be linked to the matching data.

4. Newsletter: When subscribing to the newsletter, your e-mail address will be used for our own advertising purposes until you unsubscribe from the newsletter. You may unsubscribe at any time.

5. Under German data protection law, you have the right to be informed (free of charge) of the data being held about you, as well as the right to such data being corrected, blocked or deleted, if necessary.

6. We will store the contract text and send you the order details by e-mail. You can view previous orders in your customer account.

§ 2 Sharing of data

Rasch will not share data with third parties without the consent of the user or customer or if not permitted by law, unless obliged to do so by legal, official or judicial requirements, orders or judgments.

§ 3 Credit assessment and scoring

In cases where we are required to provide goods or services before receiving payment, e.g. for a purchase on account, we may protect our legitimate interests by requesting a credit report from Bürgel Wirtschaftsinformationen GmbH & Co. KG, based on statistical and mathematical procedures. In such instance, we will provide Bürgel Wirtschaftsinformationen GmbH & Co. KG with the personal information required for the credit assessment, and we will use the information received about the statistical likelihood of a payment default for the purpose of making a balanced decision on whether to establish, implement or terminate the contractual relationship. The credit information may contain probability values (score values) that are calculated on the basis of scientifically recognised mathematical and statistical procedures and which require address details, among other things, for the calculation. Your legitimate interests will be respected in accordance with the relevant legal provisions.

§ 4 Revocation of consent, objection against use and disclosure

If the user or customer requires further information, or wishes to retrieve or revoke their explicit consent to their inventory data being used, or to object to their usage data being used, Rasch can be contacted for this purpose at the following address or by telephone, fax or e-mail:

§ 5 Use of cookies

To make our website more attractive to visitors and enable the use of certain functions, we use so-called cookies on various pages. § 6 Creation of anonymous user profiles for web analysis

On our website, we use so-called social plugins («plugins») of the social network Google+ (Google Plus), operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, California, 94043, USA («Google»). The plugins can be recognised by buttons with the sign «+1» on a white or coloured background, for example. These user profiles enable us to analyse user behaviour, improve our website and tailor it to the needs of visitors.
